The core ArbZG rules at a glance
Under §3 ArbZG the working day may not exceed eight hours; up to ten is allowed only with an average of eight within six months. §4 requires a 30-minute break after more than six hours of work, 45 minutes after more than nine. §5 guarantees eleven consecutive hours of rest between the end of one working day and the start of the next. Since the ECJ ruling of 2019 and the BAG decision of 2022, all employers — regardless of size — must also record daily working time systematically.
